BWCAW cell tower on hold until trial

AT&T has agreed to hold off building a 450-foot cell phone tower on the edge of the Boundary Waters Canoe Area Wilderness (BWCAW) in accordance with an agreement reached in court on August 4, the Timberjay newspaper reported.

The telephone company has suspended construction until a trial is held to determine if the planned tower on Fall Lake would violate the Minnesota Environmental Rights Act as Friends of the Boundary Waters contends in a lawsuit the organization filed in June.

“A trial date to test that legal theory has not been set, but is anticipated to occur no earlier than December,” the newspaper stated.

Proposed to stand 600 feet above the surrounding wilderness just 1.5 miles from the boundary of the Boundary Waters, the cell tower would be illuminated 24 hours a day with strobe and beacon lighting, the friends group said. The tower would be visible from several popular lakes within the BWCAW.
